49ers’ Brooks accused of sexual assault

The woman who accused former San Francisco 49ers defensive end Ray McDonald of rape also has accused 49ers linebacker Ahmad Brooks of sexual assault.

In a lawsuit filed Wednesday, a counter claim to a defamation suit by McDonald, the woman claims Brooks “groped her person in a sexual manner” as she lay unconscious after slipping and hitting her head at a pool party at McDonald’s residence on Dec. 14.

The woman previously had reported to police that McDonald had engaged in nonconsensual intercourse with her after she was knocked out. The lawsuit says McDonald carried her up to a bedroom after Brooks molested her.

The original police report stated that she remained at McDonald’s house the next day and engaged in consensual sex with him.

The criminal investigation into the case is still ongoing.

The woman is represented by famed women’s rights attorney Gloria Allred; the alleged victim is seeking general and punitive damages, claiming the incident has impaired her ability to work.

The 49ers released McDonald two days after the accusations, and he filed a lawsuit against the woman in March as he struggled to find a team to sign him. He eventually signed a one-year deal with the Chicago Bears.

On Wednesday, the 49ers responded to the allegation against Brooks with a statement from general manager Trent Baalke that said, “The San Francisco 49ers organization is aware of the media report regarding Ahmad Brooks. We were disappointed to learn of this matter and will continue to monitor the situation.”
